Terms of Service

Hello! Welcome to saucywendeee's Terms of Service for Commissions!Please read!Be sure to fully read my terms of service before commissioning!Should you contact me through my email or socials for commission inquiry, a copy of my terms of services will be sent to you in the response email that will include my pricing quote to ensure we are in full agreement. Thank you!General Guidelines
♡ By commissioning me, you agree to have read and fully accept my terms of service. Any rules broken from my terms of services is an immediate decline of the commission, along with being blacklisted and blocked.♡ Rude/disrespectful clients will get blacklisted and blocked. These types of clients will be refused commissions or communication from me. If this happens during the commission process, I will also refuse to continue finishing the artwork.♡ I reserve the right to refuse any commission. I can turn down your commission for any reason before, during, or after the process has begun. Forcing me to draw something that I am not comfortable with is an instant decline.♡ I retain all the rights to my work, which include but are not limited to the right to distribute, reproduce, copy and/or use the image as a sample for sales, self-promotion, or portfolios.♡ The artwork may not be reproduced, distributed, or used for NFTs (Non-Fungible Token).♡ It may not be used in any dataset, training model, or process related to artificial intelligence, machine learning, or similar technologies. This includes uploading, sharing, or distributing the artwork for the purpose of training or refining AI models, whether commercial or non-commercial.♡ I have artistic freedom to create the artwork based on the character(s) you provide. I will work with the approved references for things like poses, character appearance, or scenes but please allow and expect variations.♡ Price will vary depending on the complexity of the character design, background or other additional elements I deem fit to charge for.♡ All commissioned artworks are digital goods. Commission artworks will be delivered digitally. There will be no physical items.Customer useThe commissioner reserves the right to:
❥ Claiming rights to the original character(s), but not the artwork itself.❥ Sharing/Reposting the artwork in any place, with proper credit. You may NOT however use captions or hashtags that alter the integrity of the artwork or contain hate speech of any kind.❥ Printing the artwork for personal use only. Please ask me beforehand before doing so if you wish to do this.❥ Your personal data which may include but are not exclusive to names, emails, addresses, Paypal accounts, or personal reference photos. These will not be stored or shared with third parties, and will only ever be used as it pertains to your commission.The following is considered copyright infringement:
❥ Reproducing/Using copyrighted artwork commercially without my knowledge. Using my artwork for commercial use MUST be discussed with me before I accept the commission and will thereby alter the pricing of the commission.❥ Keeping, mass producing, or sharing any progress shots, sketches, or artworks from the commission process. This applies to both non-commercial and commercial artwork.❥ Claiming the in-progress artworks or final artwork as your own.❥ Removing my signature or watermarks from the in-progress artworks or final artwork.❥ Changing or altering the artwork. No edits can be made on the artwork under any circumstances without my consent.❥ Tracing over or copying the in-progress artworks from the commission process or final artwork.❥ Using in-progress artworks from the commission process or final artwork on platforms/accounts that are monetized.Payment
♡ Payment is only made through Paypal.♡ If your Paypal email is different from the email you are initially responding with, you must let me know.♡ Full payment must be upfront within the first 48 hours that the commission has been accepted. Commission(s) will NOT be started until payment is made.♡ No discounts can be discussed. If you would like to discuss the primary quote I provided for you, it must be done before the commission is officially accepted.♡ Fees can be asked upon and incurred based on supplementary things for example but not limited to: extra revisions, heavy amount of details, rushed deadlines, or rights for commercial use. Please discuss these topics with me at an appropriate and reasonable time.♡ Do NOT send me any payments until I have provided a quote for you.Refunds
♡ NO refunds or holds can be made.♡ If for any reason I cannot finish the artwork for a justifiable reason, I will decide if a full refund can be made.Delivery time
♡ Commission may take up to 4 weeks minimum depending on the complexity of the artwork, commission queue, and my personal circumstances. I will inform you through email if it will be finished sooner than anticipated.♡ Delays may arise depending on factors like order of commission, complexity, health, work, or family issues.♡ If delays arise, you will be notified via email. If possible, a new estimated deadline will be provided.♡ If you would like the commission to be made on a quicker yet reasonable deadline, you must state so before the commission has been accepted. Fees will incur based on this and can vary depending on the date you would like to have it finished.♡ Deadlines may be extended depending on the difficulty of revisions asked for and approved of.Commissioner/Client Guidelines
♡ Loose description of what the commission should look like is required. Detailed description is preferable. Make sure you are clear on what needs to be present or included in the artwork.♡ Descriptions should include things like but are not limited to: character appearance, age, height, body type, skin tone, clothing, personality traits, composition, facial expressions, or posing.♡ To keep things less cluttered through email, try to make the description into bullet points or short sentences.♡ Provide references. These include and are not limited to: color palette(s), poses, background, lighting, character design, character sheets, or aesthetic boards. Simple mockups (i.e. stick figures, quick sketches) created by the client are okay. Any way in which you can give me a clearer picture of your commission is greatly appreciated.♡ Using references not made by the client are okay but they must be stated as not theirs when provided. References not made by the client will only be used for visual reference or inspiration. I will NOT trace or make exact copies of such references under any circumstances.♡ Video game screenshots can be used as references. Please make sure they are well-lit so the colors are more accurate (Send the exact digital color palette with labels if you have to). Please provide front, side, and back views of the subject as well.♡ Send these references and descriptions over email or in the case the files are too large, send them over through a Google Drive folder. JPEGs, PNGs, and document files are fine.♡ In the case where you have any size, resolution and/or color mode requirements, please inform me as soon as possible.♡ If I have already created the file and worked on it for some time, I might not be able to change it.♡ If I have to find references myself, an additional fee to the final quote price will be added. You will be notified if I added reference fees to the final quote price, so we can discuss it if needed.♡ In the case that you would like to use a cropped version of the final artwork for an icon or header, discuss this with me so I can choose whether I approve or don't approve of doing so for you.Commission Process/Workflow
♡ After you have read the terms of services and sent me the filled commission form, I’ll ask for more details through email if needed and answer any of your question(s). Once I have responded at least once, I’ll come back to you within the 24 hours to give you my quote price.♡ After finding common ground, getting the payment, and giving the estimated completion date, I will start working on your commission.♡ If you would like in-depth updates on the progress of your commission, please let me know prior to starting the commission.♡ You can try to email me if you'd like any updates during the commission process, but please expect some delay before receiving a response.♡ Please inform me if the commissioned artwork needs to be temporarily kept secret or have a publication delay.♡ I will use Trello to provide general progress updates. If you have a preferred name or social media handle you would like me to use there, please let me know. If not, a shortened version of your email will be used.♡ For Trello, a short description of the commissioned artwork (for example, full color bust for single character) will be used along with the name unless the commissioner states otherwise.Step 1/Sketch stage
♡ I will sketch some ideas then show them to you via our provided place of communication so you can choose and/or tweak one to your liking.♡ You can expect 3 thumbnails minimum.♡ You may ask for revisions on the thumbnails provided but you may NOT ask for additional thumbnails unless I approve of doing so.♡ Please be sure to have provided the base color palette you would like for the commission at this point.Step 2/Color stage
♡ I will color the thumbnails with the decided base colors. This is where I will figure out lighting and other general tweaks for the artwork.♡ Colors may be tweaked based on what I find necessary for the artwork.Step 3 / Refining stage
♡ I will refine the sketch and colors. This is what your commission will look like before I render it further.Step 5 / Rendering stage
♡ This will take the most time in the commission process. I may not be able to update as much as before during this time.♡ If you would like any updates at all at this point of the process, please communicate with me on our provided place of communication. I may not answer right away but expect a response within a few days time.Step 6 / Final touches
♡ I will be adding the final touches to the artwork. These may include but are not limited to things like effects, filters, textures, and rendering.♡ Just like the rendering stage, you may communicate with me but please expect a delay in response.Step 7 / Sending files
♡ The final touches to the artwork will have been made, ready to be sent.♡ I will send a final email through the one that we have been communicating from in order to send you the final artwork.♡ The final artwork will be sent as a PNG file at 300 DPI unless asked or stated otherwise. Other factors like size or color requirements for example are based on what the commissioner asked for.♡ Once the commission is finished, no more changes or edits can be made.♡ I have the right to use the final artwork for portfolios, self-promotion, or other uses. If I post these artworks anywhere, I’ll put a special commission watermark on it.♡ I may share these final artworks on platforms like but not limited to my Instagram, Instagram, Twitter, Bluesky, TikTok, or Tumblr, so please provide your social media handle or preferred name in our email discussions in order to give you credit for the character(s) used in the commissioned artwork.♡ If no social media handle or preferred name is given for the credit, it will simply be credited as a commissioned artwork both in description and in the watermark used.♡ If the artwork was agreed upon through email to be temporarily kept secret or have a publication delay, I will make sure to keep that in mind.Revisions
♡ These apply to the three thumbnail sketches sent during the sketch stage.
♡ Commission revisions must be reasonable.Bust: 2 revisions during sketch stage.
Half Body: 2 revisions during sketch stage.
Full Body: 3 revisions during sketch stage.♡ Additional revisions after the sketch stage will be charged 5-20% of the base price, depending on complexity.♡ If you wish to change a part of the painting you have previously approved, I will charge you an extra fee.♡ If the client requests a scrapping of the artwork elements in its majority or entirety, they will be charged again.♡ Any mistakes from my end, such as forgetting any key details from the initial email request, will be fixed for free.Do’s and Don’ts
